This document regulates the access, download, and use of the desktop application CoolerTracker (hereinafter, 'the Application'), owned by CoolerTracker. By using the Application, the user expressly accepts these Terms of Service.
CoolerTracker grants the user a personal, non-exclusive, non-transferable, and revocable license to install and use the Application on their computer, exclusively for personal and non-commercial purposes. Reproduction, distribution, assignment, public communication, reverse engineering, or any other unauthorized use of the Application or its source code is prohibited.
All intellectual and industrial property rights over the Application, its design, code, logos, texts, images, and functionalities belong to CoolerTracker or its respective licensors. The use of the Application does not imply in any case the transfer of intellectual property rights to the user.
The Application is available exclusively for Windows systems and requires an Internet connection to verify the user's subscription status. CoolerTracker does not guarantee that the Application will function uninterruptedly or free of errors, although it will strive to maintain its proper functioning.
To use the Application, the user must log in using their Google account. The user is responsible for the accuracy of the data provided and for the diligent use of their access credentials.
Full access to CoolerTracker's functionalities requires an active paid subscription. Payments are managed through Stripe, which acts as the data processor for billing and secure payment processing. CoolerTracker offers two modalities: (a) monthly subscription, and (b) lifetime subscription through a one-time payment. The lifetime subscription will remain active as long as CoolerTracker maintains the development and operation of the project, without this implying an obligation to maintain it indefinitely.
Users may request a refund within a maximum period of 7 calendar days from the payment date. CoolerTracker reserves the right to accept or reject the request based on the circumstances of the case. Refunds will be processed using the same payment method used.
The user undertakes not to perform any of the following actions: (a) use the Application for illicit or unauthorized purposes; (b) distribute, copy, or resell the Application; (c) modify, decompile, or reverse engineer the software; (d) remove copyright notices or registered trademarks; (e) share access credentials or licenses with third parties; (f) use automated or unauthorized methods to manipulate the system's operation or subscription verifications.
CoolerTracker is provided 'as is' without express or implied warranties. CoolerTracker is not responsible for any damages arising from the use of the Application, including, among others, loss of data, corruption of the PokerTracker 4 database or other programs, calculation errors in metrics, or any economic or moral harm. The user uses the Application at their own risk.
CoolerTracker is independent software and is not affiliated, sponsored, or authorized by PokerTracker, Holdem Manager, or any online poker room or gaming platform. All mentioned trademarks belong to their respective owners.
CoolerTracker may suspend or cancel the user's access in case of breach of these Terms, fraudulent use, or manipulation of the licensing system. Account cancellation does not exempt the user from previously acquired obligations.
CoolerTracker may modify these Terms of Service at any time. The modifications will take effect from their publication on the website coolertracker.app or in the Application itself.
These Terms are governed by Spanish law. Any controversy will be submitted to the Courts and Tribunals of Murcia, unless the applicable regulations provide otherwise.
